1. Shipment Transactions

Electric Motor Wholesale, Inc. ships products throughout the United States and may support international export shipments by quotation only. Shipment method, freight terms, and export responsibilities depend on the order type, destination, carrier, appointed forwarder, and quotation terms.

This page explains how shipment risk, carrier claims, Ex Works shipments, export documents, and EEI/AES filing support are handled.

All website shipment transactions and freight costs are in adherence with shipment incoterm "CIP - Destination". More information on incoterms defined can be found at the International Chamber of Commerce website. https://iccwbo.org/resources-for-business/incoterms-rules/incoterms-2020/

a. Shipment Contract

All items purchased from Electric Motor Wholesale, Inc. are made pursuant to a shipment contract unless otherwise stated in writing.

For standard website and quoted shipments, risk of loss and title pass to the customer when the goods are delivered to the carrier. Electric Motor Wholesale, Inc. is not responsible for carrier delays, loss, damage, or other liabilities once the shipment has been tendered to the carrier.

We will make reasonable efforts to help customers resolve carrier issues, but claims for missing or damaged shipments must be submitted through the shipment carrier.

b. Missing or Damaged Shipment

Customers must inspect shipments promptly upon delivery.

If a shipment is missing, damaged, delayed, or delivered short, the customer must begin a claim with the shipment carrier. After a carrier claim has been opened, the customer may contact Electric Motor Wholesale, Inc. with the claim number so we can assist with order fulfillment follow-up where possible.

For freight shipments, visible damage should be noted on the delivery receipt or bill of lading before signing. Concealed damage should be reported to the carrier as soon as discovered.

c. Shipping Times

Shipping dates, delivery dates, transit times, and freight quotes are estimates only.

Carrier delivery estimates may be provided by carrier API, freight quote, or third-party shipping service. Electric Motor Wholesale, Inc. will make reasonable efforts to meet estimated shipment dates, but we cannot guarantee carrier performance, transit time, customs clearance time, weather delays, port delays, or other events outside our control.

d. Service Area

ElectricMotorWholesale.com currently processes domestic U.S. shipments through online checkout.

International shipments, export shipments, customer-arranged freight, and special freight terms must be quoted by an Electric Motor Wholesale, Inc. representative. To request an international or export shipment quote, contact:

2. Incoterms

Electric Motor Wholesale, Inc. may use different Incoterms depending on the order, shipment method, and quotation.

Common shipment terms include:

• • CIP – Carriage and Insurance Paid To for quoted shipments where EMW arranges freight and insurance to the named destination.
  • EXW – Ex Works for customers who arrange pickup, export movement, or use their own freight forwarder or shipment account.
  • DDP – Delivered Duty Paid for select small-parcel shipments where duties and taxes are prepaid online.

Incoterms are published by the International Chamber of Commerce. More information is available from the ICC Incoterms 2020 rules and the official U.S. trade resource Know Your Incoterms.

Incoterms describe commercial shipment responsibilities between buyer and seller. They do not, by themselves, determine all U.S. export filing obligations, customs obligations, tax obligations, or regulatory responsibilities.

3. Ex Works (EXW) Shipments

a. What Ex Works Means

Ex Works, or EXW, means the seller makes the goods available at a named location, and the buyer is responsible for arranging transportation from that location.

For Electric Motor Wholesale, Inc., the named EXW location is typically our U.S. warehouse in Delaware unless otherwise stated in writing.

Under EXW terms, EMW is responsible for making the goods available for pickup, safely packaged and labeled for collection. The buyer is responsible for arranging the carrier, freight forwarder, shipment account, export movement, customs broker, import process, and all related transportation costs unless otherwise agreed in writing.

b. EXW Is Not a Product Pricing Term

EXW describes shipment responsibility. It does not change the product price.

Customers sometimes confuse EXW with a discount or pricing condition. EXW only means the buyer is arranging and paying for transportation, export handling, customs clearance, import charges, and related logistics after the goods are made available for pickup.

c. Buyer Responsibilities for EXW Shipments

If a customer chooses an Ex Works shipment, the customer is responsible for:

• • Selecting and coordinating the carrier, freight forwarder, customs broker, shipment account, or export agent.
  • Providing EMW with required pickup paperwork, including shipping labels, bill of lading, carrier pickup documents, or forwarder instructions.
  • Confirming pickup date, pickup time, carrier requirements, and warehouse instructions with EMW before collection.
  • Paying all carrier, freight forwarder, broker, export, import, duty, tax, storage, demurrage, customs, destination, and related transportation charges unless otherwise stated in writing.
  • Confirming whether export filings, customs declarations, certificates, permits, licenses, or destination-country documentation are required.
  • Ensuring the appointed forwarder, broker, carrier, or authorized filing agent has the authorization and information needed to complete required export documentation before pickup.

Shipment pickup may be delayed if the buyer, carrier, freight forwarder, broker, or authorized filing agent has not provided required documents or completed required export steps.

d. EMW Responsibilities for EXW Shipments

For EXW shipments, Electric Motor Wholesale, Inc. will make the goods available for pickup at the agreed warehouse location.

When available and applicable, EMW may provide supporting shipment information such as:

• • Commercial invoice
  • Packing list
  • Product description
  • Shipment value
  • Package count
  • Package weight and dimensions
  • Pickup location and warehouse contact details
  • Country of origin
  • HS code or Schedule B information
  • Seller / USPPI information
  • SLI / LOI upon request

EMW provides this information to help the customer’s appointed carrier, freight forwarder, customs broker, or authorized filing agent complete the shipment process.

EMW does not act as the customer’s freight forwarder, customs broker, importer, export compliance consultant, or EEI filing agent unless this has been specifically agreed in writing.

4. EEI / AES Filing for Export Shipments

Electronic Export Information, or EEI, may be required for certain U.S. export shipments. EEI is filed through the Automated Export System, or AES.

Whether EEI is required depends on shipment value, destination, product classification, export control status, license requirements, and other regulatory factors. General information about EEI and AES filing is available from the U.S. Census Bureau’s Foreign Trade Regulations and Export Filing AES resources.

For U.S. export documentation purposes, Electric Motor Wholesale, Inc. is generally the U.S. Principal Party in Interest, or USPPI, when we are the U.S. seller of the goods.

For buyer-arranged Ex Works shipments, the shipment may be handled as a routed export transaction when the foreign buyer or foreign principal party in interest authorizes a U.S. freight forwarder, customs broker, carrier, or other authorized agent to facilitate export from the United States.

When EEI filing is required for a routed export transaction, the authorized U.S. filing agent is typically responsible for preparing and submitting the EEI/AES filing. This filing agent may be the buyer’s appointed freight forwarder, customs broker, carrier, or another properly authorized export agent.

Electric Motor Wholesale, Inc. provides required shipment and seller information that is reasonably available to us and needed for the export filing. Upon request, EMW may provide a Shipper’s Letter of Instruction / Letter of Instruction, or SLI/LOI, and supporting export information to the appointed forwarder, carrier, broker, or authorized filing agent.

Providing shipment information, an invoice, packing list, SLI, or LOI does not mean EMW is acting as the customer’s freight forwarder, customs broker, export compliance consultant, or EEI filer unless this has been specifically agreed in writing.

The party submitting EEI through AES is responsible for the filing submission. EMW remains responsible for the accuracy of the information it provides.

Pickup or shipment release may be delayed until the appointed forwarder, carrier, broker, or authorized filing agent confirms that any required EEI/AES filing or export documentation has been completed.
